Federal Agencies and Actions to Watch: What Employers Need to Know
A number of federal agencies have gotten off to an unusually slow start in the Biden Administration. However, employers should expect OFCCP, EEOC and other DOL agencies to pick up the pace on issuing regulations and increasing enforcement. In addition, FTC and SEC are expected to finalize their proposed regulations on noncompetes and human capital disclosures respectively. Meanwhile, mostly unnoticed by most nonunion employers, NLRB is reversing years of precedence in ways that will impact union and nonunion employees alike on severance agreements, rules of conduct and discipline.

The topic of the year so far is AI and how the federal agencies will regulate its use by employers in making employment decisions. EEOC, FTC, CFPB and DOJ recently issued a joint statement on AI which indicates the Biden Administration’s determination to regulate AI in ways appropriate to each agency’s mission.
