On Friday, August 19th, OFCCP posted in the Federal Register a notice of a FOIA demand the Agency received for all federal contractors and first-tier subcontractors nationwide EEO-1 Company Consolidated (Type-2) data for 2016 through 2020.

OFCCP stated that all federal prime contractors and first-tier subcontractors have an opportunity to file objections to the disclosure of their EEO-1 data. Those objections must be filed by September 19, 2022.

  • This FOIA demand for five years of company-wide EEO-1 data for every contractor nationwide poses unique challenges for employers to consider.
  • Employers should determine whether to file objections to disclosure and if so how to do that with the greatest likelihood of success. There are important considerations, facts, options, and strategy for employers to consider before settling on the right response strategy.
