TILG is excited to kick off our first meeting in 2016 with nationally sought after and recognized expert in the field of affirmative action compliance, John C. Fox, Esq. John is a partner in the California based law firm Fox, Wang & Morgan, P.C. Mr. Fox represents companies and tries cases in state and federal courts throughout the United States. Mr. Fox has extensive trial experience, having spent more than 300 days in trial. Mr. Fox was also lead trial counsel in the first of the four wage-hour class actions known to have been tried in California and was lead trial counsel in what are believed to have been the two largest disability law suits in the United States. Additionally, Mr. Fox was the California Employment Law Expert Witness testifying on behalf of the Board of Directors of The Walt Disney Company in the shareholder derivative lawsuit challenging Disney’s approximately $140 million severance payment to former Disney President Michael Orvitz. The Court credited Mr. Fox’s expert testimony in a surprise ruling in favor of Disney in year 2005’s largest lawsuit. Mr. Fox was also previously Executive Assistant to the Director of the Office of Federal Contract Compliance Programs (OFCCP), U.S. Department of Labor, where he was responsible for all enforcement and policy matters. Apart from drafting substantive employment discrimination regulations at OFCCP, Mr. Fox was responsible for OFCCP’s contacts with Congress, other federal agencies and The White House. In addition to speaking at the Annual ILG National Conference, Mr. Fox is the primary faculty member of the National Employment Law Institute’s (NELI) Affirmative Action program series held nationwide every year in October.
Also joining us will be Candee Chambers, Vice President of Compliance & Partnerships at DirectEmployers Association in Indianapolis. Ms. Chambers leads the Association’s compliance initiatives, oversees the creation of strategic partnerships with a multitude of organizations that allow DirectEmployers members to share their job opportunities with job seekers, and manages the relationship with the National Association of State Workforce Agencies (NASWA). She regularly shares her expertise and guidance to DirectEmployers Members, and has had the opportunity to speak extensively across the US at Affirmative Action related conferences, regional ILG meetings, and ILG National Conferences. Ms. Chambers also serves as a faculty member of the National Employment Law Institute’s (NELI) Affirmative Action program series held nationwide each year in October.

Recent Significant OFCCP Developments
We will start with recent developments of note at OFCCP affecting compliance obligations and OFCCP audits. We will also discuss the EEOC proposed EEO-1 Report and what it will mean for all Title VII employers with at least 100 employees.
Who is an Employee?
In parallel with the Wage-Hour Division, OFCCP is putting pressure on employee misclassification issues, including Joint-Employment issues. We will discuss how to think about this issue and catalogue many kinds of workers which are counter-intuitively employees who contractors must include in AAPs and statistical disparity analyses.
Things the Blogs Have Wrong
Finally, the session will end on a fun topic to correct erroneous information published in recent blogs, advertisements, surveys, and webinars. There might even be a quiz to see how many errors the attendees can uncover!
